1. Acceptance of terms
By creating an account or using Swanx, you agree to these Terms of Service. If you do not agree, do not use Swanx.
These terms apply to all users — individual subscribers and corporate team members.
2. The service
Swanx provides AI-powered negotiation training simulations. Users practice negotiation scenarios against AI counterparts and receive scored coaching feedback.
Swanx is a training tool. It is not a substitute for professional negotiation advice, legal counsel, or qualified coaching. Outcomes from real negotiations are not guaranteed by use of Swanx.
3. Accounts
3.1 Eligibility
You must be at least 16 years old to create a Swanx account. By creating an account you confirm you meet this requirement.
3.2 Account security
You are responsible for maintaining the security of your account. Do not share your login credentials. Notify us immediately at security@swanx.app if you suspect unauthorised access.
3.3 Accurate information
You agree to provide accurate information when creating your account and to keep it current.
4. Plans and payment
4.1 Free plan
The free plan provides limited access as described on the pricing page. We may change free plan limits with 14 days' notice.
4.2 Paid plans
Paid plans (Pro and Elite) are billed monthly. Payment is processed by Dodo Payments. For B2B enterprise accounts, invoicing is processed via Payoneer. Your subscription renews automatically unless cancelled.
4.3 Cancellation
You may cancel your subscription at any time through your profile settings or by contacting support@swanx.app. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months.
4.4 Refunds
We offer a 7-day refund for first-time subscribers if you are not satisfied. Contact support@swanx.app within 7 days of your first payment. Refunds are not available after 7 days or for subsequent billing cycles.
4.5 Price changes
We will notify you of price changes with at least 30 days' notice. If you do not cancel before the price change takes effect, you consent to the new price.
5. B2B team accounts
5.1 Manager responsibilities
Team managers are responsible for ensuring that team members are informed that their scores and progress data are visible to managers through the dashboard. Managers must not add users to a team without their knowledge and consent.
5.2 Seat limits
Team accounts have seat limits as described in the plan. Adding more members than your plan allows is not permitted.
5.3 Data on team termination
If a team account is cancelled, individual user accounts remain active on their individual plan (free, unless they independently subscribe). Team-level data (aggregate reports) is deleted 30 days after cancellation.
6. Acceptable use
You agree not to:
- Use Swanx to harass, threaten, or harm any person
- Attempt to reverse-engineer, decompile, or extract the AI models, prompts, or scoring logic
- Circumvent usage limits (e.g. creating multiple free accounts)
- Share your account with others
- Use Swanx for any unlawful purpose
- Attempt to gain unauthorised access to other users' data or our systems
- Use automated tools to interact with Swanx without our permission
- Upload or input content that is illegal, harmful, or infringes third-party rights
We reserve the right to terminate accounts that violate these rules without refund.
7. Intellectual property
7.1 Swanx content
The Swanx platform, including all software, design, scenarios, coaching frameworks, and brand elements, is owned by Stratix Technologies LLC (Wyoming, USA). You may not copy, reproduce, or create derivative works without our permission.
7.2 Your content
You retain ownership of content you input into Swanx (e.g. your negotiation responses). By using Swanx, you grant us a limited licence to process your input to provide the service.
7.3 AI-generated content
Coaching reports and AI responses are generated by Swanx. You may use these for personal development and training purposes. You may not republish, sell, or redistribute AI-generated coaching content.
7.4 Feedback
If you provide feedback or suggestions, we may use these to improve the product without any obligation to you.
8. Disclaimers
Swanx is provided "as is" without warranties of any kind. We do not guarantee:
- That the service will be uninterrupted or error-free
- That AI responses will be accurate, complete, or appropriate for all situations
- That using Swanx will improve your real-world negotiation outcomes
- Any specific result from use of the service
The AI counterparts and coaching feedback are for training purposes only. They represent simulated scenarios and should not be treated as advice for specific real-world negotiations.
9. Limitation of liability
To the maximum extent permitted by applicable law, Swanx's total liability to you for any claims arising from these terms or use of the service shall not exceed the greater of (a) the amount you paid us in the 3 months preceding the claim, or (b) one hundred US dollars ($100) for free-tier users.
We are not liable for indirect, incidental, special, or consequential damages, including lost profits, loss of data, or business interruption. Nothing in these terms limits liability that cannot be limited under applicable law, including liability for fraud or gross negligence.
10. Termination
10.1 By you
You may delete your account at any time through your profile settings or by contacting support@swanx.app.
10.2 By us
We may suspend or terminate your account if you violate these terms, if we believe your account has been compromised, or if we discontinue the service. We will provide reasonable notice except where immediate action is required for security reasons.
10.3 Effect of termination
On termination, your access to Swanx ends. We will retain your data as described in the Privacy Policy.
11. Governing law and disputes
These terms are governed by the laws of the State of Wyoming, United States of America, without regard to its conflict of law principles. Any disputes shall first be attempted to be resolved through good faith negotiation. If unresolved within 30 days, disputes shall be referred to binding arbitration under the rules of the American Arbitration Association, conducted in English.
Nothing in this section limits any right you may have under mandatory consumer protection law in your country of residence that cannot be waived by agreement.
12. Changes to these terms
We will notify you of material changes to these terms by email with at least 14 days' notice. Your continued use of Swanx after the notice period constitutes acceptance. If you do not agree to the changes, you must cancel your account before they take effect.
